Welcome to AfoMarket (“we,” “us,” “our,” or “Company”). These Terms & Conditions govern your use of our website and the purchase of any products from our online store. By placing an order, you agree to be bound by these terms.

1. Accuracy of Information

By using this site, you agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and other information, including your email address and shipping details, so that we can complete your transactions and contact you as needed.

Any information you provide must be truthful and accurate. Providing false information may result in order cancellation without refund.

2. Product Quality & Perishables

Natural Variation

AfoMarket specializes in authentic, naturally processed Nigerian foodstuffs (e.g., sun-dried fish, beans, grains, spices). Because these are natural products, you acknowledge that there may be slight variations in color, size, texture, and appearance compared to the images displayed on our site. These variations do not indicate quality issues.

Freshness Guarantee

We ensure all items are vacuum-sealed and freshly prepared in Nigeria before dispatch. However, once a package is delivered or picked up, you are responsible for proper storage to maintain quality:

  • Refrigerate perishables immediately upon receipt
  • Store in airtight containers
  • Follow any product-specific storage instructions

AfoMarket is not responsible for quality degradation after delivery due to improper storage by the customer.

3. Pricing & Payments

Currency & Display

Prices are displayed in Nigerian Naira (₦). Payment is processed through Paystack and will reflect in your local currency.

Freight vs. Clearance Fees

What’s Included in Your Order:

  • Product cost
  • Freight shipping from Nigeria to destination country
  • Logistics handling

What’s NOT Included (Separate Fees):

  • Local clearance fees at destination (e.g., $2 CAD/kg in Canada, $3 USD/kg in USA)
  • Duty and tax charges imposed by local customs authorities
  • Doorstep delivery fees (if requesting custom quotes)

You acknowledge and agree to pay these additional fees as required by logistics partners or local authorities.

Pricing by Service Type

Weekly Service:

  • UK: ₦7,500/kg (doorstep)
  • USA: ₦10,000/kg (office pickup; includes clearance)
  • Canada: ₦7,000/kg + $2 CAD clearance (office pickup)
  • Europe: ₦18,500/kg (doorstep)

Express Service:

  • UK: ₦13,500/kg (doorstep)
  • USA: ₦28,000/kg (doorstep)
  • Canada: ₦27,000/kg (doorstep)
  • Europe: ₦21,500/kg (doorstep)
Pricing Errors

In the event of a technical error where a product is listed at an incorrect price, AfoMarket reserves the right to cancel the order and provide a full refund.

4. International Shipping & Customs

Shipping Timelines

Weekly Service (Consolidated):

  • UK: 12-13 working days
  • USA: 1+ week (office pickup) or 2+ weeks (doorstep, custom quote)
  • Canada: 1+ week (office pickup) or 2+ weeks (doorstep, custom quote)
  • Europe: 2 weeks

Express Service:

  • UK: 5-6 working days
  • USA: 5-7 working days
  • Canada: 7-8 working days
  • Europe: 8-9 working days

All timelines are estimates and begin after your order is processed and dispatched from Nigeria.

Liability for Delays

AfoMarket is not liable for delays caused by:

  • Airline schedules and flight delays
  • Holiday seasons and reduced customs staffing
  • Customs inspections or processing delays
  • Border inspections
  • Extreme weather conditions
  • Port congestion
  • Carrier delays
Delivery Address Responsibility

We are not responsible for:

  • Lost shipments due to incorrect or incomplete delivery addresses
  • Misdelivered packages to wrong addresses
  • Packages left at incorrect locations

You are responsible for providing a complete, accurate delivery address.

Local Regulations & Import Restrictions

While AfoMarket has curated its inventory to comply with international shipping standards, you are ultimately responsible for ensuring that the items you order are permitted for import into your specific country. Import restrictions vary by country and may change. If customs authorities refuse your shipment, AfoMarket is not liable.

Duty & Tax Charges

Local customs authorities may impose duty and tax charges on your shipment:

  • USA (Express): Duty charges may apply before delivery
  • Canada (Express): Duty charges are typically applied before delivery
  • Europe: Duty and tax charges may sometimes apply

These charges are separate from AfoMarket’s fees and are determined by local authorities.

5. Restricted & Prohibited Items

Completely Prohibited

The following items cannot be shipped and orders containing them will be cancelled:

  • Medication
  • Wood products
  • Hair/body sprays
  • Pesticides
Restricted Items (Express Service Only)

The following items can ONLY be shipped via Express service only:

  • Goat meat
  • Ponmo (cow skin)
  • Snail
  • Guinea fowl
  • Chicken and chicken-based products

Important: These items have an 80% success rate. There is a 20% risk that items will be seized at customs. If your restricted item shipment is seized:

  • AfoMarket is not liable for the loss
  • We cannot guarantee replacement or refund
  • You acknowledge this risk when ordering restricted items

Restricted items are NOT permitted on Weekly/Consolidated services.

Liquid Items

Allowed on Weekly Service:

  • UK: Yes
  • USA: Yes
  • Canada: Yes
  • Europe: Yes

NOT allowed on Express Service:

  • UK: No
  • USA: No
  • Canada: No
  • Europe: Yes (allowed on both)

6. Returns & Refund Policy

No Returns for Perishables

Due to international food safety regulations and the perishable nature of our products, all sales are final. We cannot accept returns of food items once they have been dispatched from Nigeria.

Damaged Goods Exception

If your package arrives with significant damage (e.g., broken vacuum seal, visible leakage):

  1. Contact us within 24 hours of receipt with photographic evidence
  2. We will investigate and may issue a refund or replacement at our sole discretion
  3. Photographic evidence must clearly show:
    • The damaged package/seal
    • The damaged product
    • The delivery date/receipt date

Without photographic evidence within 24 hours, no refund or replacement can be issued.

Non-Eligible for Refund

Refunds will not be issued for:

  • Customer preference or change of mind
  • Taste preferences or quality expectations not being met
  • Items that have been opened or partially consumed
  • Improper storage after delivery (customer responsibility)
  • Allergic reactions or health issues
  • Items damaged due to improper handling by customer after receipt

7. Limitation of Liability

AfoMarket shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profit or business opportunity
  • Adverse reactions or health issues arising from food allergies
  • Food poisoning or illness resulting from improper handling/preparation by customer after delivery
  • Seizure of restricted items at customs
  • Delays caused by customs, airlines, or weather
  • Lost or misdelivered packages due to incorrect addresses

Your exclusive remedy for any dissatisfaction is a refund of the product cost only (excluding shipping fees).

8. Intellectual Property

The name AfoMarket, our logo, branding, product descriptions, and photography on this website are the exclusive property of AfoMarket and may not be used, copied, reproduced, or distributed without our express written consent.

9. User Conduct

You agree not to:

  • Use this website for any illegal purpose
  • Harass, threaten, or abuse other users
  • Attempt to gain unauthorized access to our systems
  • Upload malware or harmful content
  • Engage in fraudulent transactions
  • Provide false information to circumvent shipping restrictions

Violations may result in account termination and legal action.

10. Modifications to Terms

AfoMarket reserves the right to modify these Terms & Conditions at any time. Changes become effective upon posting to the website. Continued use of the site after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria.

For disputes, you agree to attempt resolution through our customer service before initiating legal proceedings.
